End User License Agreement

This agreement governs your use of the AfroHoney application downloaded from the Apple App Store.

e-Global Media Consulting LLC ("Licensor") grants you a limited, non-exclusive, non-transferable, revocable license to use the AfroHoney application ("App") on any Apple-branded device that you own or control, subject to the Usage Rules set forth in the Apple Media Services Terms and Conditions.
This license does not allow you to use the App on any device you do not own or control, and you may not distribute or make the App available over a network where it could be used by multiple devices at the same time.

You may not copy, decompile, reverse-engineer, disassemble, or attempt to derive the source code of the App.
You may not modify, adapt, or create derivative works of the App.
You may not rent, lease, lend, sell, redistribute, or sublicense the App.
You may not remove, alter, or obscure any proprietary notices on the App.
You may not use the App for any purpose that is illegal or prohibited by these terms.
The Licensor reserves all rights not expressly granted to you.

You agree that the Licensor may collect and use technical data and related information — including but not limited to technical information about your device, system and application software, and peripherals — that is gathered periodically to facilitate the provision of software updates, product support, and other services related to the App.
The Licensor may use this information to improve its products or to provide services or technologies to you, as long as it is in a form that does not personally identify you. See our Privacy Policy for full details.

AfroHoney offers auto-renewing subscription memberships: Gold Membership (enhanced features at a monthly subscription rate) and Platinum Membership (premium features at a monthly subscription rate).
Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
Your account will be charged for renewal within 24 hours prior to the end of the current period at the subscription rate. You can manage and cancel your subscriptions by going to your Apple ID account settings after purchase.
Any unused portion of a free trial period (if offered) will be forfeited when you purchase a subscription.

This EULA is effective until terminated by you or the Licensor.
You may terminate this EULA by deleting the App from your device and discontinuing use.
The Licensor may terminate this EULA at any time if you fail to comply with any of its terms.
Upon termination, you must cease all use of the App and destroy all copies in your possession. Termination of this license does not entitle you to any refund of subscription fees.

The App may enable access to the Licensor's and/or third-party services and websites (collectively, "External Services"). You agree to use the External Services at your sole risk.
The Licensor is not responsible for examining or evaluating the content or accuracy of any third-party External Services and shall not be liable for any such third-party services.
Data displayed by the App or External Services, including but not limited to financial, medical, and location information, is for general informational purposes only and is not guaranteed by the Licensor.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
THE LICENSOR DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
No oral or written information or advice given by the Licensor shall create a warranty.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE LICENSOR BE LIABLE FOR ANY PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, CORRUPTION OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES.
In no event shall the Licensor's total liability to you for all damages exceed the amount of fifty dollars ($50.00) or the amount you paid the Licensor for the App in the 12 months preceding the claim, whichever is greater.

This EULA is between you and e-Global Media Consulting LLC only, not with Apple Inc. ("Apple"). The Licensor, not Apple, is solely responsible for the App and its content.
Apple has no obligation to furnish any maintenance and support services with respect to the App.
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the App. Apple has no other warranty obligation with respect to the App.
Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App.
Apple is a third-party beneficiary of this EULA and, upon your acceptance, Apple will have the right to enforce this EULA against you as a third-party beneficiary.

This EULA shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
